This is the agreement a founder signs on entering the Founders' room. You aren't signing anything by reading it.

Founder's Early Access Agreement

This is an agreement between Comm-Adore, the maker and publisher of the game ("we", "us"), and you, the founder who signs it. It takes effect when you sign it by typing your name and choosing the sign button, and it applies to everything we give you as a founder before the game is released.

1. What this is about

You have bought the Founder's Edition of Hazelwood: The Crown of Power: early access to a game that is not finished and not released. This agreement sets the confidentiality rules that go with that access. It adds to the terms you bought under, including that all sales are final; it does not replace them. The Founders' room and its builds are open only to founders who have signed it.

2. What is confidential

"Confidential Information" means everything you get or learn as a founder that we have not made public ourselves, including:

  • every early build, file and download, and everything in them: the game's code, maps, graphics, music, text, story, characters, puzzles, secrets and endings;
  • features, plans, schedules, prices and release dates;
  • bugs and faults, yours and other founders', and what we say about them;
  • the Founders' room on our site and everything in it;
  • what we write to you about early access, and who the other founders are.

It does not include anything that (a) we have published ourselves (for example on our site or blog), (b) was already public through no act of yours, or (c) you can show you knew before we gave it to you or learned lawfully from someone free to tell you. Gameplay you post as section 4 allows is not a breach of this agreement. Once the finished game is released, what is in the released game is no longer confidential.

3. What you promise

You will:

  1. keep Confidential Information secret, and use it only to play the builds, report to us, and post gameplay as section 4 allows;
  2. not give, send, lend, upload, post or sell any build, or any part of one, to anyone, in any form. Nothing in section 4 changes this;
  3. not show it, except as section 4 allows: no screenshots, photos, video, streams or recordings outside that permission, and never music rips or extracted files, in public or in private;
  4. not describe it beyond what section 4 allows: no posts, messages or conversations about what we have told you, our plans, the Founders' room or other founders, anywhere, including forums, social media, chat servers and private groups;
  5. keep builds only on machines and media you control, protected so that others cannot get at them, and not let anyone else use your login;
  6. not disassemble, decompile, modify or extract a build's contents, except where the law gives you a right to that we cannot take away;
  7. tell us at once, by replying to any email from us, if you learn or suspect that a build or any Confidential Information has got out, and help us deal with it;
  8. be the only person who uses your early access. It is personal to you.

If a law, a court or an authority requires you to disclose something, you may disclose only what is required, and you will tell us first if you lawfully can.

4. Gameplay you may post

We want people to see the game before it is out. As the one exception to section 3, you may post screenshots and video of your own play of a build on your own social media and video channels, live or recorded, and talk about what they show, and you may say that you are a founder when you do. This permission holds only while you keep to all of the following:

  1. Credit us in every post. The post itself, or its description where anyone seeing it can read it, must say: Hazelwood: The Crown of Power, by Comm-Adore (comm-adore.com). If we give you an account to tag, tag it too.
  2. Say it is unfinished. Make clear that what you are showing is a pre-release build and may change.
  3. Only what you captured yourself from the game as it runs. Never a build, a disk image or any file from one, a link to one, or anything extracted from one (graphics, music, maps, text or code taken out as files). Never anything from the Founders' room, from our emails, or about other founders or their reports.
  4. Be straight about it. Do not present the game or any part of it as your own work, do not present yourself as speaking for us, and do not alter what you show so that it misleads.
  5. Take it down if we ask. We may narrow or withdraw this permission at any time by email, for everyone or for you, for all of the game or for a part of it we want kept back. If we ask you to remove a post, you will remove it within 24 hours, as far as the service lets you.

You give us permission to share, repost and quote what you post about the game, in our own channels and promotion, with credit to you, without payment.

Everything section 3 says about the builds themselves still applies in full. Showing your play is allowed; passing on the game is not.

5. Your builds are tied to you

We record every download against your login: the time, the internet address and browser it came from, and the file. Builds we give you may be made for you alone and encoded with identifiers unique to you, some hidden in the game itself, in places and forms we do not disclose.

You agree that:

  • a copy of a build carrying your identifiers is evidence that it came from your copy;
  • you are responsible for every copy of your builds, including one that gets out through someone you gave or showed it to, or through a machine or account you did not keep secure;
  • you will not look for, remove, change or hide the identifiers, or help anyone else to.

6. What you may do with a build

We give you a personal, limited, non-transferable permission to run each early build on your own equipment, and to capture your play of it for posting as section 4 allows. That is all. We keep every right in the builds and the game, including in what your posts show of it; nothing in this agreement gives you ownership of, or any other licence to, any of it. The finished game, when it is released, comes with its own terms.

7. Your reports and ideas

Anything you send us about the builds (bug reports, suggestions, ideas, saved games, recordings you make for us at our request) is ours to use, change and include in our games and elsewhere, forever and without payment or credit beyond your name on the Founders' Shrine, and you will not claim any right in the game because of it.

8. If you break this agreement

You agree that a leak of an unreleased game would harm us in ways that money alone may not put right. If you break this agreement, or it is clear that you are about to, we may close your early access at once, and that is not grounds for a refund. We may also ask a court to order you to stop (an injunction) without having to prove a particular money loss or post a bond where the law allows, in addition to claiming the losses we suffer, our reasonable legal costs where the law allows them, and any other remedy we have.

If we close your early access, or when we ask, you will delete every early build and every copy of Confidential Information you hold.

9. How long confidentiality lasts

Your promises about any piece of Confidential Information last until we make that information public ourselves, and they continue if your early access ends. For information we never make public, they last for five (5) years from the day you sign.

10. No warranty, and limits

The builds are unfinished. They are given as they are, with no warranty of any kind: they may crash, lose saved games, or not work on your equipment, and you use them at your own risk. What you post is your own responsibility. To the fullest extent the law allows, we are not liable to you for any loss arising from the builds or early access. Nothing in this agreement limits liability that cannot lawfully be limited, or takes away a right the law gives you as a buyer.

11. Your details

To run early access and to enforce this agreement we keep: your name, email address and login; this signed agreement, with the time and the internet address and browser it was signed from; the log of your downloads; and your reports. We keep them for as long as this agreement lasts. We do not sell them or share them, except with our advisers, our payment provider or a court if we need to, or where the law requires it.

12. The rest

  1. Who you are. You confirm that you are 18 or older, that you are the person who bought this Founder's Edition, and that no other agreement stops you from signing this one.
  2. Signing electronically. You agree that typing your name and choosing the sign button is your signature, with the same effect as signing on paper, and that we may send you this agreement and any notice under it by email.
  3. Law and courts. This agreement is governed by the laws of the United States, without regard to its rules on conflicts of law. The courts there have jurisdiction over any dispute about it, and we may also seek an injunction in any court where a breach is happening.
  4. Whole agreement. Together with the terms you bought under, this is the whole agreement between us about early access. It can be changed only by a new agreement that you sign in the same way.
  5. If a part fails. If a court finds any part of this agreement unenforceable, that part is to be applied as far as the law allows and the rest stays in force.
  6. No waiver. If we do not act on a breach, we have not given up the right to act on it, or on a later one.
  7. Not transferable by you. You may not transfer this agreement or your early access. We may transfer this agreement to whoever takes over the game.
